FAQ's

Frequently asked questions about Medical Negligence Claims

How long will my claim take?

The average timescale is 2 years if litigation is not needed or 3 years if it is. However, each claim is different and so it will depend to a large degree upon how the Defendant reacts to the claim as to how long it will take to resolve. At Thomson & Bancks we will always keep you updated on your claim’s progress.

How much is my Medical Negligence claim worth?

There are a number of factors which will contribute towards how much you will receive. We will need to consider:
- The nature and severity of your injuries
- Your recovery, whether there will be any long term effects on your health
- Whether any financial losses were incurred as a direct result of the injury caused

Whilst we will give you an estimate of your likely damages, medical experts and the Court may come to a different view and so it can only be used as a guideline.

Will my claim have to go to court before I receive my compensation?

Once supportive, independent medical expert evidence has been obtained on your behalf, we will be able to make a compensation claim. Most claims are discontinued or settled before Trial (95%).

I am not looking to claim compensation; I simply would like an explanation and apology?

The NHS has a complaints procedure which you will need to follow and we can provide you with information in this regard. We can then advise you further and help you make a compensation claim based upon any admission of negligence received.
