Lung And Respiratory Claims

Respiratory diseases are responsible for about a fifth of all deaths worldwide and its prevalence reaches 15% of the world population. There are many different types of respiratory disease including AsthmaAsbestosisLung CancerSilicosis, Black Lung, Brown Lung, Coal Worker’s or Farmer’s Lung and other Chronic Obstructive Pulmonary Diseases (COPD) including emphysema and bronchitis.

Our Personal Injury lawyers can assist you in bringing a claim against an employer or previous employer if you have suffered industrial disease as a result of working conditions or Noise Induced Hearing Loss (NIHL). However, our clinical negligence team can assist if you have been misdiagnosed or delayed in your diagnosis or treatment as a result of your GP or the Hospital’s care.

Studies of medical literature in this field have demonstrated the lack of consistent evidence on the accuracy of diagnoses of respiratory diseases by General Practitioners. In relation to asthma and COPD, they have shown diagnostic errors leading to over-diagnosis or under-diagnosis depending on the methodology used.

Spirometry is a method of assessing lung function by measuring the volume of air that the patient is able to expel from the lungs after a maximal inspiration. It is a reliable method of differentiating between obstructive airways disorders (e.g. COPD, asthma) and restrictive diseases (where the size of the lungs is reduced, e.g. fibrotic lung disease). Spirometry is the most effective way of determining the severity of COPD. However, other measures such as the MRC dyspnoea scale1 and quality of life assessment forms a more complete picture. Severity cannot be predicted from clinical signs and symptoms alone.

If your health has been adversely affected by a misdiagnosis or delay in treatment. At Thomson & Bancks, our medical negligence specialists will deal sensitively and efficiently with your claim for compensation or that brought on behalf of a loved one’s Estate. The civil law attempts to place people back in the same place as they would have been had they not been injured by a medical mistake or left untreated so they have not fully recovered as they should have done.

Where that is not possible, an increasing amount of damages are payable for where the consequences have been more serious for you. Also, financial losses caused by the injury or non-recovery of your condition are claimable, for instance, if you are not able to return to work or require extra services because of a resulting disability which would have been avoided had there been no negligence.

If you or your family have been affected by medical negligence, please call our specialist Solicitor, Lucy Sherry, on 01242 235250 to find out if you may have a claim. We will offer you a first free interview to learn about the next steps and our ‘No Win, No Fee’ agreements for funding your legal claim.
